The Texas Department of Family and Protective Services a/k/a Liberty County Child Protective Services (DFPS), appellant, appeals the trial courts order denying its plea to the jurisdiction, motion to dismiss, motion for summary judgment, and motion to sever, in favor of appellees, Rachel Atwood and Jonathan Oliver Atwood, Sr., individually and on behalf of the estate of Jonathan Oliver Atwood, Jr., Chance Atwood, a minor, and Christopher Atwood, a minor. Specifically, DFPS challenges the trial courts denial of its plea to the jurisdiction, contending that sovereign immunity bars the Atwoods claims against DFPS. We agree and, thus, reverse and render judgment dismissing the Atwoods suit against DFPS for want of jurisdiction.
